Terms of Service

1. Acceptance of Terms

By accessing or using XCROP's services, API, website, or any associated software (collectively, "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Services.

XCROP reserves the right to update or modify these Terms at any time. Continued use of the Services after any such changes constitutes your acceptance of the revised Terms. We will notify users of material changes via email or dashboard notification at least 14 days before they take effect.

2. Description of Services

XCROP provides a data intelligence platform for Twitter/X analytics, including but not limited to:

• •Real-time tweet search and interaction verification
• •User profile, follower, and engagement analytics
• •Account monitoring: track any X account's tweets, engagement, and follower growth
• •Trending topic and hashtag monitoring
• •Batch operations for bulk data retrieval
• •Write operations (tweet, reply, like, retweet, follow) via connected accounts

Services are delivered via RESTful API and a web-based dashboard.

3. Account Registration & Security

To access the Services, you must create an account and provide accurate, current, and complete information. You are solely responsible for:

• •Maintaining the confidentiality of your API keys, passwords, and credentials
• •All activities that occur under your account, whether authorized or not
• •Notifying XCROP immediately at [email protected] of any unauthorized access

You may not share API keys across organizations or create multiple free-tier accounts to circumvent usage limits. XCROP reserves the right to suspend or terminate accounts that violate these Terms, engage in abusive activity, or pose a security risk.

4. API Usage & Rate Limits

API usage is governed by a credit-based system tied to your subscription tier:

• •Starter (Free): 5,000 credits/month, 60 requests/minute, up to 1,000 results/call
• •Basic ($4.9/mo): 700,000 credits/month, 300 requests/minute, up to 1,000 results/call
• •Pro ($9.9/mo): 2,000,000 credits/month, 600 requests/minute, up to 1,000 results/call
• •Pay as You Go: Buy credit packs on demand, credits never expire, 300 requests/minute, up to 1,000 results/call

Credits are consumed per API call based on the endpoint type and number of results returned. Unused credits do not roll over to the next billing cycle (except Pay as You Go purchased credits which never expire). Exceeding your credit or rate limit will result in HTTP 429 (Too Many Requests) responses until the limit resets.

5. Acceptable Use Policy

You agree NOT to use the Services to:

• •Violate any applicable local, state, national, or international law or regulation
• •Infringe on the intellectual property rights of XCROP or any third party
• •Harass, stalk, threaten, or harm any individual or group
• •Distribute malware, spam, phishing content, or other malicious material
• •Attempt to reverse-engineer, decompile, disassemble, or hack the Services
• •Resell, sublicense, or redistribute raw API data without prior written authorization
• •Scrape or collect personal data in violation of applicable privacy laws
• •Manipulate financial markets or engage in fraudulent trading activity
• •Circumvent rate limits, abuse free-tier allocations, or use automated means to create accounts
• •Use Write API features to send automated spam, impersonate others, or violate Twitter/X policies

Reselling is allowed, it just needs paperwork. If you are a reseller or distributor, or you are building XCROP data into a product you sell to your own customers, email [email protected] and we will put an agreement in place. We do not charge for it.

Violation of this policy may result in immediate account suspension without prior notice.

6. Data & Privacy

XCROP processes publicly available data from Twitter/X and other public sources. We do not access private messages, protected accounts, or non-public data unless explicitly authorized by the account owner via the Write API account connection feature.

Your use of data obtained through XCROP must comply with:

• •Twitter/X Terms of Service and Developer Agreement
• •All applicable data protection laws (GDPR, CCPA, LGPD, etc.)
• •Our Privacy Policy (available in the adjacent tab)

You are solely responsible for ensuring your use of the data complies with all applicable laws in your jurisdiction.

7. Payment & Billing

Paid plans are billed monthly or annually in advance. All fees are quoted in USD. Refunds are covered in Section 8.

• •Payment methods: Cryptocurrency (USDT, USDC, SOL, POL)
• •Cryptocurrency payments must be completed within 30 minutes of invoice generation
• •Failed or declined payments may result in service downgrade after a 3-day grace period
• •Plan upgrades take effect immediately with prorated billing; downgrades apply at the next billing cycle
• •Applicable taxes (VAT, sales tax) may be added based on your billing address
• •Volume and enterprise pricing is available upon request, including invoiced billing for business customers

8. Refunds

You may request a refund within 14 days of any charge. We do not ask for a reason.

• •Subscriptions: full refund if you have used less than 10% of the plan's monthly credit allowance at the time of the request
• •Credit packs: pro rata refund of the credits still unused
• •Renewals: cancel before the renewal date to avoid the charge; a renewal already taken is refundable on the same terms
• •Refunds are returned to the original payment method and normally settle within 5-10 business days

We may decline a refund where there is evidence of abuse, such as repeated buy-and-refund cycles or use of the Services in breach of Section 5. Nothing in this section limits your statutory rights under applicable consumer law. The full policy is at xcrop.io/legal/refund.

9. Intellectual Property

XCROP and its licensors retain all rights, title, and interest in and to the Services, including all software, APIs, algorithms, documentation, trademarks, and branding.

You retain ownership of any original content or analysis you create using data obtained through the Services. However, you grant XCROP a non-exclusive, royalty-free license to use anonymized and aggregated usage data for the purpose of improving and optimizing the Services.

Nothing in these Terms grants you any right to use XCROP's trademarks, logos, or brand assets without prior written consent.

10. Service Availability & SLA

XCROP targets 99.9% API uptime on a monthly basis for all paid plans (Basic, Pro, and Pay as You Go). This excludes scheduled maintenance windows (announced at least 48 hours in advance) and force majeure events.

The Starter (free) tier is provided on a best-effort basis with no uptime guarantees. XCROP may impose additional rate limits on free-tier accounts during periods of high demand.

11. Disclaimers & Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. XCROP DOES NOT WARRANT:

• •The accuracy, completeness, or timeliness of any data
• •Uninterrupted or error-free service availability
• •Fitness for any particular trading, investment, or commercial purpose

IN NO EVENT SHALL XCROP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

XCROP'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

XCROP IS NOT A FINANCIAL ADVISOR. DATA PROVIDED THROUGH THE SERVICES DOES NOT CONSTITUTE INVESTMENT ADVICE. YOU ARE SOLELY RESPONSIBLE FOR YOUR TRADING AND INVESTMENT DECISIONS.

12. Indemnification

You agree to indemnify, defend, and hold harmless XCROP, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• •Your use or misuse of the Services
• •Your violation of these Terms or any applicable law
• •Your infringement of any third-party rights
• •Content or data you transmit through the Write API features

13. Termination

Either party may terminate this agreement at any time for any reason.

Upon termination by you: Cancel your subscription via the dashboard or by contacting [email protected]. Access continues until the end of your current billing period.

Upon termination by XCROP: We may suspend or terminate your account immediately if you violate these Terms. We will attempt to provide notice where practicable.

Upon termination:

• •Your API keys will be revoked and all access will cease
• •You must delete any cached or stored data within 30 days
• •Outstanding fees remain due and payable
• •Sections 9, 11, 12, and 15 survive termination

14. Force Majeure

XCROP shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, internet or infrastructure outages, third-party service failures (including Twitter/X API changes or restrictions), and cyberattacks.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Socialist Republic of Vietnam, where the Services are operated from, without regard to conflict of law provisions.

Any dispute should first be raised with us directly at [email protected]. We will respond within 10 business days and try to settle it informally. Anything unresolved after 30 days falls to the competent courts of Vietnam.

Nothing in this section removes mandatory consumer protections you are entitled to under the law of the country you live in.
